EXPANDED, SEE NICKY JR.'s PLANE:  Nicodemo Scarfo Junior , a member of the Luchese crime family, was sentenced to serve 360 months in prison for participating in a racketeering conspiracy and other offenses related to the looting of FirstPlus Financial Group, a Texas-based mortgage company. Scarfo and a partner used the publicly traded company to buy shell companies from which they could steal assets. FirstPlus is now defunct. He was sentenced in July. “Nicodemo Scarfo and his associates tried to take La Cosa Nostra corporate, using traditional, strong-arm mob tactics to take over a publicly traded company and loot it like a personal piggy bank,” said Assistant Attorney General Leslie R. Caldwell of the Justice Department’s Criminal Division. “The Justice Department will fight organized crime wherever it may surface—from back alleys to public board rooms—to ensure that crime does not pay.”

Nicodemo S. Scarfo and pal Salvatore Pelullo are slated to face the music (though it's continually been postponed) for their efforts to steal around $12 million from  FirstPlus Financial . Scarfo, 49, the son of imprisoned mob boss Nicodemo D. "Little Nicky" Scarfo, faces nearly life in prison, as does Pelullo, 47, an associate who helped loot the Texas-based mortgage company. Also scheduled for next week: yet another meeting as per the defense's efforts to win a new trial by maintaining that the jury in the FirstPlus case never should've been exposed to any mob-related discovery material. Scarfo and associate Salvatore Pelullo were convicted today of looting more than $12 million in less than a year from a mortgage company, and used the money to buy homes, weapons, ammunition, a plane, luxury cars, jewelry and an $850,000 yacht they named "Priceless." Both men, because of prior criminal convictions and their roles in the racket, face 30 years to life. Judge Kugler is slated to sentence the two in October. Specifically, Scarfo, the son of former Philadelphia mob boss Nicodemo D. Scarfo, was convicted of multiple counts of racketeering conspiracy, conspiracy to commit securities fraud, wire fraud and being a felon in possession of a gun. Pelullo, who prosecutors said ran the business takeover, was convicted of racketeering conspiracy, conspiracy to commit securities fraud and related counts. It looks like the waiting may be nearing an end for Nicodemo S. "It looks like the jury has voted to convict in the FirstPlus Financial racketeering fraud trial ," according to George Anastasia at Big Trial . "But at this point we don't know which one -- or how many -- of the seven defendants have been found guilty."

Nicky Scarfo Jr's defense has an extra week to generate more fodder to use in their filibuster. Charged with taking over the Texas-based FirstPlus Financial mortgage company and looting its shareholders of $12 million, Nicodemo S. Scarfo and Salvatore Pelullo face a week of idle wondering about their future fates. There will be no testimony this coming week, according to U.S. District Judge Robert Kugler, who has to tend to some housekeeping issues. The prosecution rested on April 22nd, and the defense began making its case, which was projected to last around three weeks at that time. Word is that George Anastasia has been in attendance. The defense is said to be filibustering, which means, basically, stalling. By the way, is anyone wondering why Nicky Scarfo Junior is a member of the Luchese family?

A few hours after a rowdy shareholders meeting formalized what federal authorities allege was Salvatore Pelullo's secret takeover of FirstPlus Financial, Pelullo hosted a celebratory dinner for company officers and members of the board of directors at a posh steakhouse in Dallas. As he sat at the head of a long table in a private dining room at DelFrisco's on that night in October 2007, a violinist serenaded Pelullo repeatedly with the same song, said Robert O'Neal, then chairman of the board and president of FirstPlus. O'Neal, testifying for the prosecution at the racketeering trial of Pelullo, mobster Nicodemo S. Scarfo and five other defendants, said the song was all too familiar and somewhat ominous.
