Reputed Luchese Soldier Joey Glasses Has Dementia, His Lawyer Tells Judge

US District Judge of the US District Court for the Southern District of New York Cathy Seibel recently received an update on the health of reputed Luchese crime family soldier Joseph (Joey Glasses) Datello, who will make an appearance in an upcoming story written with information from Luchese defector John Pennisi.

Datello, 69, was hit with a 14-year prison sentence in 2019 after he pleaded guilty to conspiracy to commit racketeering, including the attempted murder of a witness.

In the letter to Judge Seibel, defense attorney Theodore S. Green wrote:

“Yesterday, Mr. Datello’s family was advised by email from a social worker at FCI Hazleton that Mr. Datello has been transferred to a hospital pending his transfer to a BOP medical facility. The family was advised in the email that the transfer was “because of his dementia” and that Mr. Datello does not have an active case of COVID-19. I have informed AUSA Scott Hartman of this development.

“In the September 21, 2020, order with respect to our renewed compassionate release motion, the Court determined that the application was premature in that neuropsychological testing has yet to be conducted. The BOP had previously indicated that it intended to await Datello’s transfer to a medical facility before conducting such testing. The government has advised me that, pursuant to the Court’s directive, it has been seeding to determine when the transfer to a BOP medical facility will take place but has not yet received a response.

“Now that Mr. Datello is in a hospital, it is our position that the neuropsychological testing can and should be conducted there and that this will avoid unnecessary delay. Accordingly, we request that the Court so direct the BOP. Further, the family is not being told what hospital Mr. Datello is in and they wish to have phone contact with him. Accordingly, it is further requested that the BOP be directed to facilitate a phone call between Mr. Datello and his family. Very truly yours.”

As per the BOP, Joey Glasses is currently at Devens FMC, a medical center in Fort Devens, Massachusetts. His release date is May 5, 2029.

Datello had faced life in prison for crimes that included a trip in October 2016 to the home of an alleged informant to kill him.

Datello was among the 19 defendants linked to the Luchese family who were busted in 2017 and charged with an array of crimes including murder, attempted murder, racketeering, gambling, witness tampering and narcotics trafficking. Datello was among five Staten Island defendants named in a superseding indictment unsealed in federal court in White Plains.
